CUSTER COUNTY Deputy Attorney in MILES CITY, Montana

CUSTER COUNTY POSITION DESCRIPTION POSITION: Deputy Attorney DEPARTMENT: County Attorney's Office ACCOUNTABLE TO: County Attorney FAIR LABOR STANDARD ACT: Non-Exempt _x Exempt SUMMARY OF WORK: Provides legal counsel to county offices, employees, and Commissioners: fulfills duties of County Attorney as provided by law including criminal prosecution. JOB CHARACTERISTICS: Nature of Work: This position performs professional and complex duties in conducting and coordinating legal proceedings and rendering legal advice, requiring adherence to professional standards, confidentiality, and integrity. Consequence of error could lead to possible liability suits and acquittals on technical grounds. This position may occasionally work under threats from potential mental commitments and criminal defendants. Position may require work outside of regular working hours. Personal Contacts: Continual contact with public; daily coordination of duties with other county departments and employees; frequent contact with related criminal justice and law enforcement personnel. Supervision Received: Supervision from County Attorney; adheres to policies as established by the County Attorney. Essential Functions: As Deputy County Attorney, position requires ability to communicate orally and in writing, investigate cases, do research, read written material, understand and explain complex laws, attend court, maintain records and files, and have good judgment. AREAS OF JOB ACCOUNTABILITY AND PERFORMANCE: Performs duties of County Attorney as mandated in MCA 7-4-2717 in County Attorney's absence; provides legal counsel to all county employees, and state employees operating within the county; renders legal advice to board of county commissioners, and attends meetings as required. Defends county against suits, claims and accounts; renders legal opinions for county offices; advises law-enforcement agencies; institutes proceedings before magistrates for arrest; presents indictments to grand jury; draws all indictments and information; conducts state prosecutions for public offenses; institutes and prosecutes civil actions for state; defends state against suits; prosecutes recovery of debts, fines, penalties, and forfeitures; recovers county monies illegally paid out; maintains register of all civil and criminal actions and proceedings; acts as counsel for school, fire, soil conservation, and weed districts; performs other related duties as required. JOB REQUIREMENTS: Knowledge: This position requires a thorough knowledge of criminal law, litigation, and legal research; a working knowledge of contracts and torts; of tax, family, natural resources, and employment law. Skills: This position requires skills in keyboarding, legal writing, word processing, and computer aided research. Abilities: This position requires the ability to: deal with stress; work effectively in the courtroom; convey a professional and competent image; work independently; have self-initiative; adhere to professional standards of confidentiality and integrity; communicate effectively orally and in writing; follow verbal and written instructions; establish effective working relationships with county staff, law enforcement personnel, and the public. EDUCATION AND EXPERIENCE: The above knowledge, skills, and abilities are typically acquired through a combination of education and experience, a law degree and admission to the State Bar. This position requires a license to practice law in Montana. Experience in courtroom trial work and criminal law is preferred. Position salary set by statute in Montana Code Annotated (7-4-2505) and as approved by the Board of County Commissioners. Position graded for comparison only. Immediate vacancy. Full-time permanent Deputy County Attorney position with the Custer County Attorney's Office, Miles City, Montana. Juries Doctor degree from accredited law school, licensed to practice in Montana.
